Contractual Disputes & Troubleshooting

Askival gets involved in a wide range of problem-solving and troubleshooting activities to help sort matters out, particularly when contractual relationships go wrong.

Unfortunately, contractor insolvency – with the impact of cost and project delay – is becoming more commonplace. We are skilled in dealing with this event when it happens, and we can prepare for it in advance by undertaking scheme-specific audits as well as putting together bespoke action plans in readiness.

At other times, local authorities and registered providers bring us in to deal with individual contractual claims. For example, despite signed and agreed contracts, a builder might ask for a significant uplift on costs.

Other disputes can arise from ambiguous wording in the contract, quality of workmanship, the causes of and justifications for delays – in fact disputes can arise during any part of the construction process.

This service can include:

  • Coordination of actions immediately on confirmation of a contractor’s insolvency
  • Contract review and analysis
  • Dispute resolution assistance
  • Project performance evaluation
  • Define the future approach to risk identification, management and mitigation
